Colour additives are used in food for many reasons, e.g. to compensate for colour loss during processing or storage, to correct natural variations in food colour and to improve the appearance of certain foods to meet consumer demands and expectations. However, some of these substances, such as Sudan dyes, pose a potential risk to human health.
The EU’s current legal framework on food coloring establishes a positive list of approved colors for use in food, excluding all others. Since Sudan dyes are not included on this list, their presence in food constitutes a violation of EU regulations. Sudan I is unlawfully used to artificially enhance the color of food.
On 20 June 2003, the Commission adopted Decision 2003/460/EC, implementing emergency measures to tackle the presence of Sudan I in chili and chili products. The Decision aimed to prevent contamination at the source by testing raw materials before use.
Following the adoption of Decision 2003/460/EC, notifications received through the RASFF revealed that Sudan I contamination affected a broad range of food products, including chili and curry powders, as well as processed foods containing chili or curry. In addition to Sudan I, other related dyes (Sudan II, Sudan III, Sudan IV, and Scarlet Red) were also found in chili and chili products within the EU.
To address these findings and ensure proper monitoring, Commission Decision 2004/92/EC, adopted on 21 January 2004, amended the original measures. This revision extended the scope to include curry powders and the other Sudan dyes (Sudan II, III, IV), while also requiring testing for Sudan dyes beyond just Sudan I.
In 2025 for the first time in Progetto Trieste programme it will be presented a PT for Sudan and other illegal dyes in chili sauce.
